ARTICLE 1 – Legal Notice
The techniques practiced have no medical purpose and are not comparable to acts reserved for healthcare professions regulated by the French Public Health Code and Decree No. 96-879 of October 8, 1996, nor to acts reserved for paramedical or healthcare support professions.
ARTICLE 2 – Scope of Application
These General Terms and Conditions of Sale for services apply, without restriction or reservation, to all services offered by O fleurs du bien.
Session bookings are available for the following services:
Bach Flower consultation sessions, either in person or remotely by video conference, lasting one hour.
ARTICLE 3 – Prices, Terms and Methods of Payment, Invoice
Service prices are displayed at the appointment location in euros and include all taxes (VAT included). These prices correspond to those in effect on the day the appointment is booked and according to the selected services.
Payment is made on the day the service is provided by the following methods:
Cash (for in-person consultations only), French bank cheque payable to O fleurs du bien, credit card (subject to bank confirmation) via SumUp terminal (receipts sent only by email or SMS), online registration and payment by credit card via Stripe, or bank transfer (for remote consultations).
At the end of the service, an invoice will be provided or sent to the client.
ARTICLE 4 – Session Booking, Cancellation and Appointment Rescheduling
The client may book a Bach Flower consultation session by email at sabrina.mlynarczyk@gmail.com, through Facebook via the page, directly by phone, through the website contact form, or through a dedicated booking platform: Specific Calendar
To book a service by phone or email, the client must complete the following process:
- Choice of service and acceptance of the price
- Choice of date and time according to availability
- Provision of contact details (surname, first name, telephone number, email address)
- A confirmation message is then sent by SMS or email before the session.
- Acceptance of the General Terms and Conditions and acknowledgment of the legal notice during the session.
CANCELLATION OR RESCHEDULING OF APPOINTMENTS
O fleurs du bien requires advance notice for cancellation or rescheduling of a session.
Cancellations made by email to sabrina.mlynarczyk@gmail.com less than 24 hours before the session will incur a penalty equal to the session fee. Cancellations made at least 24 hours before the scheduled session time will not incur any penalty.
If the client fails to attend the scheduled session without prior notice, they will be required to pay a no-show fee equivalent to the cancellation fee.
If the client must cancel within the late cancellation period due to an emergency beyond their control, O fleurs du bien may waive the cancellation fee.
ARTICLE 5 – Provision of Services
The services booked by the client will be provided on the date and at the time chosen during the booking process and according to the detailed description displayed at the appointment location.
CLIENT OBLIGATIONS
The client agrees to provide O fleurs du bien with all information necessary for the proper execution and smooth running of the session. The client remains responsible for the content and accuracy of the information provided during booking and throughout the session.
The client must inform O fleurs du bien in writing and prior to the session of any specific circumstances that may affect the course of the session.
The client must attend the session on the scheduled date, time, and location (for in-person sessions).
For remote sessions, the client must follow the instructions provided by O Fleurs du bien and connect to the video conference slightly before the scheduled time. The client must also carry out any necessary technical tests beforehand.
In all cases, it is the client’s responsibility to inform O Fleurs du bien sufficiently in advance of any delay.
LIABILITY
O Fleurs du bien cannot be held liable for any failure or improper performance resulting from the client’s actions, particularly in the event of failure to communicate relevant information.
O Fleurs du bien shall not be held responsible for delays or failures resulting from force majeure as defined by French law and case law.
ARTICLE 6 – Protection of Personal Information
In accordance with French Law No. 78-17 of January 6, 1978, personal data requested are necessary for appointment booking and are exclusively intended for client management by O Fleurs du bien.
The client has the right to information, access, rectification, deletion, restriction, portability, erasure, and objection regarding their personal data. Requests may be made by email to sabrina.mlynarczyk@gmail.com.
The client also has the right to lodge a complaint with the CNIL in France if they believe their personal data are being processed in violation of applicable laws.
Data used for the provision of requested services are retained for the duration of the contractual relationship and archived in accordance with statutory limitation periods, for a maximum period of 5 years from the client’s last contact. Data are deleted once retention periods expire.
If sensitive data are collected, and in compliance with applicable legislation, a consent agreement will be proposed to the client at the beginning of the consultation session.

ARTICLE 8 – Consumer Mediation
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, in the event of a dispute, O fleurs du bien offers access to a consumer mediation service.

ARTICLE 9 – Dispute Resolution
These General Terms and Conditions are governed by French law, including any disputes relating to their validity, interpretation, execution, or termination. In the event of a dispute and failure of mediation or amicable settlement, jurisdiction shall be assigned to the competent courts. The reference language for dispute resolution is French.
ARTICLE 10 – Payment Method
The seller reserves the right to suspend order processing and delivery in the event of refusal of payment authorization by accredited banking institutions or in the event of non-payment.
